These Terms of Service ("Terms") govern your use of noelexpresss.com and any purchase you make through it. The site is operated by XENO PRINTS LLC, a limited liability company registered in the State of New Mexico, United States, with its registered office at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110 ("we", "us", "our"). By using the site or placing an order you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, and able to enter into a binding contract. We sell only to customers with a shipping address in the 48 contiguous United States or the District of Columbia. We do not knowingly sell to anyone outside that area.
2. The products we sell
We sell outdoor footwear for adults — water shoes, rain boots, hiking and walking sandals, barefoot and zero-drop sneakers and cold-weather boots. Our products are not children's products and are not sold or sized for children.
Product images and descriptions are supplied by the manufacturer. Colors vary between screens, and there is normal manufacturing variation between a photographed sample and the pair you receive. Measurements are approximate.
3. Where orders ship from
Orders are dispatched from our partner warehouse overseas in China and delivered within the United States by USPS or FedEx. Import duties are paid by us and included in the price. Returns are handled at our facility in Austin, Texas. Timings, costs and exclusions are set out in our Shipping Policy and our Refund & Returns Policy, which form part of these Terms.
4. How a contract is formed
Everything on this site is an invitation to buy, not an offer. When you place an order you are making an offer to buy. The confirmation email we send immediately afterwards acknowledges that we have received your order; it does not accept it. A contract is formed only when we dispatch the items and send you a dispatch confirmation.
We may decline or cancel an order at any point before dispatch — for example if the item is unavailable, if there was a pricing or description error, if we cannot deliver to your address, or if we suspect fraud. If we cancel an order you have already paid for, we refund you in full.
5. Pricing and errors
All prices are in United States dollars (USD). Prices include import duties. Sales tax, where it applies, is added at checkout based on your shipping address and is shown before you pay. Shipping is charged separately as set out in our Shipping Policy.
Despite our efforts, an item may occasionally be listed at an incorrect price or with an incorrect description. If the error is obvious and could reasonably have been recognised as a mistake, we may cancel the order even after payment, and we will refund you in full. We will always contact you first.
We may change prices at any time. A change does not affect an order we have already accepted and dispatched.
6. Your account
If you create an account you are responsible for keeping your login details confidential and for everything done through your account. Tell us immediately if you think someone else has access to it.
7. Acceptable use
You agree not to use the site to break any law, to scrape or copy it systematically, to interfere with its operation or security, to resell our products as an authorised dealer without our written agreement, or to submit content you do not have the right to submit.
8. Reviews and customer content
If we publish customer reviews, they are published as written by the customer. In line with the Federal Trade Commission's Rule on the Use of Consumer Reviews and Testimonials (2024):
- We do not write, buy, commission or fabricate reviews, and we do not ask anyone else to.
- We do not offer money, discounts, free products or any other incentive in exchange for a review or for a particular rating.
- We do not suppress or delete negative reviews, and we do not reorder reviews to hide them.
- We do not use insider reviews written by the company, its owners or their families without clearly disclosing the connection.
By submitting a review, a photograph or any other content, you grant us a non-exclusive, royalty-free licence to display it in connection with the product and our marketing, and you confirm you own it or have permission to submit it. We may remove content that is unlawful, abusive, off-topic or fraudulent.
9. Intellectual property
The site design, our text, our brand name and our logo belong to us or our licensors. You may not copy or reuse them without permission. Product imagery is supplied to us by our manufacturers and remains theirs.
DMCA notices
If you believe material on this site infringes your copyright, send a written notice to support@noelexpresss.com including: your signature (electronic is fine); identification of the copyrighted work; the URL of the material you say infringes it; your contact details; a statement that you believe in good faith the use is not authorised; and a statement, under penalty of perjury, that the information is accurate and you are authorised to act. We remove infringing material when a valid notice is received, and we will pass your notice to the party who supplied the material, who may file a counter-notice.
10. Disclaimers and limitation of liability
The site is provided "as is". To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Our total liability arising from any order is limited to the amount you paid for that order.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of this section may not apply to you. Nothing here affects your rights under the consumer protection laws of your state.
11. Disputes
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules.
Before starting any formal action, please email support@noelexpresss.com so we can try to resolve the matter directly. Most problems are settled this way within a few days.
If that does not work, you may bring a claim in the courts of the state where you live, or in the small claims court of your county, and we agree to submit to that court's jurisdiction. We will not ask you to travel or to litigate somewhere inconvenient.
Your rights as a consumer are not affected by this section. Nothing in these Terms limits the authority of the Federal Trade Commission or your state Attorney General, or your right to file a complaint with either of them.
12. Changes to these Terms
We may update these Terms. The version that applies to your order is the one published when you placed it. The "Last updated" date at the top shows when this version took effect.
13. Miscellaneous
If any part of these Terms is held to be unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Shipping Policy, Refund & Returns Policy, Payment Policy, Privacy Policy and Disclaimer, are the whole agreement between us.
